Terms of Delivery and Payment

General
Our Terms and Conditions are the basis of any kind of services or goods supplied by formfalt Kunstprodukte Triebel + Brandis GbR. Errors excepted.

Prices
The prices listed in our catalogue are in Euro and must be paid plus the Value Added Tax (VAT) prescribed by law. The prices are subject to change.

Orders
Place the order always in written form (via fax, post or e-mail).

Payment
After delivery, the total invoice amount shall be transferred to our bank account within 14 days or as per agreement. We allow a discount of 2% in case of payment within 7 days. In case of non-compliance with our payment terms we will ship products only after advance payment.

Exceedance of the date of payment
If the date of payment is exceeded inspite of a reminder, the damage caused by delay, at least of the amount of costs for a bank credit in the moment of delivery, must be allowed to formfalt Kunstprodukte Triebel + Brandis GbR. If the customer exceeds the date of payment, the total claim of that business connection will become due at once.

Delivery Conditions and Time
Outside Berlin, the shipment will be sent by parcel service and will be charged as per expense. We will charge 3.50 Euro flat rate for packaging. National shipment will be sent within 10 days, international shipment within 20 days.

Visible damage or non-received orders must be claimed immediately, i.e. 1 week after receipt or non-receipt of the goods at the latest, with a precise description. The transportation of goods will be executed at the customer's risk. We refuse to accept liability for meeting certain delivery dates.

Minimum Order
We have a mimimum order of 100,00 Euro, for foreign countries we have a mimimum order of 200,00 Euro. Transport costs will be charged as per expense. In general, the payment of customs duty and further costs arising in the foreign country are chargeable to the purchaser.

Warranty
In case of justified defects, formfalt Kunstprodukte Triebel + Brandis GbR reserves the right to repair the claimed defects or to replace the defective goods.

Retention of title
The delivered products will remain the property of formfalt Kunstprodukte Triebel + Brandis GbR until complete payment by the purchaser.

Applicable law/Place of jurisdiction
Subject to German law. Place of jurisdiction is Berlin.
